GUINNESS® Collectors Club's User Agreement.

1. This Agreement is a legal document which sets out your rights and obligations in relation to the services offered by the GUINNESS® Collectors Club at the site Guinntiques.com.

2. By registering at the GUINNESS® Collectors Club site you agree to the terms of this Agreement, and you re-affirm that agreement every time you visit the GUINNESS® Collectors Club site.

3. Intellectual Property

The GUINNESS word, the HARP device and the ARTHUR GUINNESS signature are trade marks and are reproduced under licence. You are not allowed to use or reproduce any of these without express permission of the trade mark owner.
Many of the images used on this site are also reproduced under licence, including but not limited to the images designed by John Gilroy and the GUINNESS® bottle labels. You are not allowed to use or reproduce any of these images without the express permission of the rights owner.
By using this site, you do not obtain any rights to any of the images or trade marks on this site. While you're welcome to view the site and print hard copies of anything on it for your own personal use, you are not allowed to copy or use anything on the site for any other purpose, such as any business or commercial use. In addition, you are not allowed to modify or distribute anything on the site for any purpose at all.

4. Membership Eligibility

You undertake to register for the GUINNESS® Collectors Club site using your correct name, email address and any other requested details. If you wish to become a Full Member of the GUINNESS® Collectors Club site, you will be asked to enter details of a credit or debit card; you must ensure that (a) you are fully entitled to use that card both at the time when you enter its details on the GUINNESS® Collectors Club and when you seek to use it, and (b) it has available funds sufficient to cover the Full Membership Fee.

In any event, to register for the GUINNESS® Collectors Club site you must be of or over the legal minimum age for purchasing alcoholic beverages in the country in which you are resident.

5. Membership Fees

The current Annual Membership fee is £11.00.

We may change our fees from time to time. Our changes are effective after we provide you with at least fourteen (14) days' notice of the changes by posting the changes on the GUINNESS® Collectors Club site homepage.

You are responsible for paying all applicable taxes.

6. Services

We may in our sole discretion change some or all of our services at any time. In the event we introduce a new service, the fees for that service are effective at the launch of the service. Unless otherwise stated, all fees are quoted in GBP (£).

7. Use of the GUINNESS® Collectors Club Valuation Service.

The GUINNESS® Collectors Club offers among its many services appraisals of GUINNESS® memorabilia. An appraisal at the GUINNESS® Collectors Club is the best assessment, as determined by the person performing the appraisal, of the value of an item based on his or her assessment of the item at the time of appraisal. This assessment may include, but does not guarantee to include, the research of past auctions and sales of similar items, any historical information that exists in the public domain and any information that you have provided. Since this appraisal is a best assessment, and since the marketplace for the item will change at any moment and affect its valuation, the appraisal cannot be guaranteed.

8. Use of the GUINNESS® Collectors Club electronic greeting cards service.

We will use your email address and the email address of the person to whom you wish to send the ecard solely to process your ecard. Your email address will be disclosed to the person to whom you wish to send the ecard. We will not use your email address or the email address of the person to whom you wish to send the e-card for any other purpose.

9. Registration

Our registration form requires you to give us contact and billing information (like your name and email address). Contact information in particular is used to check whether you qualify for registration.

We also use information you provide on the registration form for accounting purposes and to contact you when necessary (for example, to respond to your queries or for other customer service issues).

The GUINNESS® Collectors Club will not use your data for any purpose except as set out above or disclose it to any other person, unless you have given your consent to the GUINNESS® Collectors Club doing so, either during registration or at some other time. We do not send out newsletters or bulk communications to our membership and respond only to enquiries. We may however disclose your data if we are either compelled to do so by law, or in response to a valid, legally compliant request by a law enforcement or governmental authority.

10. Cookies

We may use and store 'cookies' to help us recognise you on any return visits you make to our site and to make any procedure easier for you. Cookies are small pieces of information which will be stored by your browser on your computer's hard drive. The cookies used by us will not give us any personal details about you.

11. Liability Limit

This website is owned and run by Nicholas Fairall and neither Diageo plc nor any of its associated companies are liable for the content on this site or any aspect of the performance of the site.

Nothing in this Agreement is intended to limit or exclude any liability on the part of the GUINNESS® Collectors Club where and to the extent that applicable law prohibits such exclusion or limitation. In particular, if you are a consumer YOUR STATUTORY RIGHTS ARE NOT AFFECTED.

12. General

This Agreement shall be governed in all respects by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to any dispute relating to this Agreement or use of the website. We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
